Welcome to the HiFi Repairs website, hifirepairs.com.au (the “https://hifirepairs.com.au/”). The Website is operated by HiFi Repairs trading as HiFi Repairs (“HiFi Repairs”, “we”, “us” or “our”).

By accessing or using this Website, requesting a quote, booking a repair, purchasing a product or using any of our services, you agree to be bound by these Terms & Conditions (“Terms”). Please read these Terms carefully before using our Website or engaging our services.

These Terms apply together with any specific terms provided to you at the time of booking, quotation, purchase or repair.

Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law (ACL) or any other applicable law.

1. Website Use

You may use this Website for lawful purposes only.

You agree not to:

  • use the Website for any unlawful, fraudulent or unauthorised purpose;
  • interfere with or attempt to interfere with the operation or security of the Website;
  • introduce viruses, malware or other harmful code;
  • attempt to gain unauthorised access to the Website or any associated systems;
  • copy, reproduce or commercially exploit Website content without our permission; or
  • provide information that is false, misleading or inaccurate.

We reserve the right to modify, update, suspend or discontinue any part of the Website at any time without prior notice.

Any price or repair estimate displayed on the Website is generally an estimate only unless we have expressly confirmed a final price to you.

A final repair price may depend on inspection of your device and identification of faults or additional damage.

Where additional work is required, we may contact you before proceeding where reasonably practicable.

3. Repair Services

HiFi Repairs provides repair services for compatible phones, tablets, laptops, MacBooks and other electronic devices as advertised on our Website.

When you submit a repair request or booking:

  1. the information you provide must be accurate;
  2. we may inspect the device before confirming the repair;
  3. the initial quote may change if additional faults or damage are identified;
  4. parts availability may affect the estimated completion time; and
  5. a repair is not considered confirmed until HiFi Repairs accepts the booking or otherwise confirms the repair with you.

Estimated repair times are estimates only and may vary depending on the nature of the repair, parts availability, device condition and other circumstances.

4. Device Condition and Existing Damage

Before commencing a repair, HiFi Repairs may inspect and document the condition of your device.

You should tell us about any known:

  • physical damage;
  • liquid damage;
  • previous repairs;
  • software problems;
  • missing components;
  • security locks;
  • account restrictions; or
  • other known faults.

Where a device has pre-existing damage or faults, repair of one component may not resolve unrelated problems.

For example, a device with existing liquid damage, board damage or multiple faults may develop additional symptoms during diagnosis or repair.

We will take reasonable care when handling your device. However, where a device has pre-existing damage, severe physical damage, liquid damage, corrosion, weakened components or previous third-party repair work, the repair may carry additional risks.

5. Data, Backups and Device Security

You are responsible for backing up your data before submitting a device for repair.

You should, where possible, back up:

  • photos and videos;
  • contacts;
  • messages;
  • documents;
  • applications;
  • passwords;
  • account information; and
  • any other important data.

Repair, testing, software updates, resetting or replacement of components may result in loss of data or settings.

HiFi Repairs does not guarantee that your data will be preserved during a repair.

You are responsible for providing any required passcodes, passwords or access information where necessary for testing, subject to our privacy and security procedures.

We recommend removing sensitive information that is not required for the repair.

6. Repair Data Loss Notice

Devices submitted for repair may contain stored personal information and data.

You acknowledge that repair work may, in some circumstances, result in loss of stored data.

You should therefore maintain an independent backup before handing your device to us.

Where required by applicable Australian law, HiFi Repairs will provide any required repair notice concerning potential data loss.

7. Parts and Replacement Components

Depending on the repair, HiFi Repairs may use:

  • new parts;
  • genuine manufacturer parts where available;
  • compatible replacement parts;
  • refurbished parts; or
  • other suitable components.

The type of part used may depend on availability, device model, repair type and the option agreed with you.

Where refurbished goods or refurbished replacement components are used, we will provide any disclosures required by Australian law.

For repairs where refurbished goods may be used, the following notice applies where required:

“Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.”

The ACCC requires specific repair notices in certain circumstances, including where goods may be repaired with refurbished parts or replaced with refurbished goods.

8. Repair Approval and Additional Work

If inspection identifies a fault or damage that was not included in the original quote, we may provide you with an updated quote.

Where reasonably practicable, we will seek your approval before carrying out additional chargeable work.

If you do not approve additional work, the device may be returned to you in its existing condition, subject to any applicable inspection, diagnostic or other agreed charges.

Nothing in this section limits your rights under the Australian Consumer Law.

9. Repair Cancellation

You may request cancellation of a repair before work has commenced.

Where a repair has already commenced, cancellation may be subject to reasonable charges for work already performed, parts ordered or other costs incurred, except where otherwise required by law.

If a cancellation or refund right applies under the Australian Consumer Law, these Terms do not limit that right.

10. Collection of Repaired Devices

When your repair is completed, we may contact you using the contact details provided during your booking.

You should collect your device within a reasonable period after being notified that it is ready.

If a device remains uncollected for an extended period, we may contact you to arrange collection or another appropriate solution.

We will not treat an uncollected device as abandoned or dispose of it contrary to applicable law.

11. Door-to-Door, Pickup and Delivery and Mail-In Repairs

Where HiFi Repairs offers pickup, delivery, door-to-door or mail-in repair services, additional conditions may apply.

Availability of these services may depend on your location and the type of device or repair.

Our door-to-door service is currently available in Melbourne, subject to service-area availability.

For mail-in repairs, you are responsible for securely packaging your device unless otherwise agreed.

You should retain proof of postage or delivery where applicable.

We recommend using appropriate protective packaging and a trackable delivery service.

12. Device Ownership

You confirm that:

  • you own the device you submit for repair; or
  • you have permission from the owner to arrange the repair.

You must not submit a device that you do not have lawful authority to possess or repair.

HiFi Repairs may request reasonable information to verify ownership or authority where necessary.

13. Lost, Stolen or Suspicious Devices

If we reasonably suspect that a device has been stolen, unlawfully obtained or is subject to an ownership dispute, we may refuse or suspend the repair and may take reasonable steps required by law.

We may request proof of ownership or other information before releasing a device.

14. Payment

Payment must be made using the payment method offered by HiFi Repairs.

Prices displayed on the Website may change from time to time.

Unless otherwise stated, prices are in Australian dollars (AUD) and may include GST where applicable.

You are responsible for paying the agreed price for services or products supplied to you, subject to any rights you have under the Australian Consumer Law.

15. Warranties and Consumer Guarantees

HiFi Repairs may provide a separate warranty for certain repairs, replacement parts or products. Where a warranty applies, its specific terms will be provided to you.

Any HiFi Repairs warranty is additional to your rights under the Australian Consumer Law.

Consumer guarantees cannot be excluded, restricted or replaced by a business warranty or these Terms.

Mandatory Australian Consumer Law Notice

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

For goods, additional consumer guarantee rights may include repair, replacement or refund depending on the circumstances and whether the failure is major or minor.

16. Repair Warranty

Where HiFi Repairs provides a specific repair warranty, the warranty period and applicable conditions will be communicated to you at the time of repair.

A repair warranty may apply only to the component or repair service performed and may not cover unrelated faults or subsequent damage.

Depending on the applicable warranty terms, warranty claims may not cover issues caused by:

  • accidental damage;
  • liquid damage;
  • physical damage;
  • misuse;
  • unauthorised repairs or modifications;
  • tampering;
  • abnormal use; or
  • damage occurring after the original repair.

These exclusions do not limit any rights you have under the Australian Consumer Law.

17. Refurbished and Used Products

Where HiFi Repairs sells refurbished, pre-owned or used devices, the condition of the product will be described as accurately as reasonably possible.

Product descriptions may include information about:

  • cosmetic condition;
  • battery condition;
  • functionality;
  • included accessories;
  • storage capacity;
  • model;
  • colour; and
  • other relevant characteristics.

Minor cosmetic marks or signs of previous use may be present on refurbished or pre-owned products.

Any known faults or limitations that are required to be disclosed will be communicated in accordance with applicable law.

Consumer guarantees continue to apply to eligible purchases, including applicable purchases of second-hand goods.

18. Website Content

All content on this Website, including text, graphics, images, logos, designs, photographs, videos and other materials, is owned by or licensed to HiFi Repairs unless otherwise stated.

You may view and use Website content for personal, non-commercial purposes.

The HiFi Repairs name, logo and associated branding are owned by or used with permission by HiFi Repairs.

30. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify rights and remedies available under the Australian Consumer Law.

The Australian Consumer Law provides automatic consumer guarantees for eligible goods and services, including guarantees relating to acceptable quality, fitness for purpose, due care and skill, and reasonable time for services where no timeframe has been agreed.

Where a product or service fails to meet a consumer guarantee, the remedy available may include repair, replacement, refund, cancellation or compensation depending on the circumstances.
